You are receiving this notice because you have submitted, or will submit, your candidacy for employment with RXO, Inc. or one of its subsidiaries or affiliates (“RXO”).  This Notice confirms the data collection process and background checking (if an offer is made) that will apply in connection with your application for employment with RXO (the “Application”). 

RXO respects your privacy rights and interests and adheres to its Electronic Recruitment Privacy Policy (the “Policy”) when processing your personal information.  For additional detailed information about RXO’s practices in regard to the collection, processing, use and disclosure of personal information, please refer to the Policy.  

In submitting your candidacy or completing the application form via RXO’s online applicant system, provided and operated by SAP (“SAP”), you have supplied, and RXO and SAP will process, the personal data specified in this notice as part of the application process.  Personal data collected at initial stages will include: 

  • Your name, former name, and contact details (i.e. address, home and mobile phone number, email address)
  • Details of your qualifications, experience and employment history, including without limitation employer identity, job title and other related information, and whether you have ever worked for specific companies with a particular relevance to RXO.
  • Other information you include in your application, which might include a cover letter, resume, CV, references and their contact details, or other supporting documentation
  • Whether you are aged 18 or over.
  • Whether you have relatives who work for RXO.
  • Work authorization/eligibility
  • Where required/permissible by law, your race, gender, disability, and veteran status

RXO and SAP may also collect and process the following information, and before making a final decision to recruit, to the extent permitted by the law of the country of the group company making the job offer or recruitment process:

  • Information about your previous academic and/or employment history, including details of any conduct, grievance or performance issues, appraisals, time and attendance, from references obtained about you from previous employers and/or education providers; and
  • Information regarding your academic and professional qualifications.

At a further stage in the recruitment process, RXO may carry out background checks (some of which may also, or alternatively, be carried out about by a selected third-party background check agency(ies)) in connection with the Application, which may require processing of additional personal data, including information regarding your criminal record. You will be notified and asked to consent to this background check at the relevant stage in the process in order for the recruitment process to continue.  We may need to disclose to such selected third-party agency(ies) certain data relating to you to facilitate their carrying out of the relevant checks.  The background check requirement may cover the following information and sources if relevant, subject to applicable law:  

  • Criminal records, including driving records
  • Education Records 
  • Employment History 

In addition, as part of the recruitment process, RXO may process additional information regarding your nationality and immigration status from related documents, such as your passport or other identification and immigration information, as provided by you. 

RXO processes your personal data for its legitimate interest in acquiring, developing, and retaining talent as well as maintaining employment records and good employment practices. We process your personal data on this legal basis so long as you do not object that these purposes are overridden by your interests, rights or freedoms.

In connection with the Application (and/or as part of the background checking process if applicable) and potential business transactions, we may also need to disclose personal data obtained to the following entities located outside the European Economic Area, the UK, and/or the country you live and/or intend to work as the case may be: RXO, SAP, background checking agencies and other third party sources of information, in-house recruiters, hiring managers, RXO group company HR managers, professional advisers, third-party service providers (including recruiting agencies), IT service providers, and regulatory and other competent bodies.  Data transferred to the above entities located in the US or outside the country you live and/or intend to work will be subject to adequate safeguards such as standard contractual clauses. A copy is available from RXO upon your request.  The laws and standards regarding data privacy in the US and other countries outside the EU, the UK, and the country you live and/or intend to work do not necessarily provide a level of protection equivalent to the data protection laws and standards in the EU or the country you live and/or intend to work. Your personal data will only be used for the purposes set out in this Statement.  However, we will disclose data where required to comply with law, for example with regulatory requirements and immigration approvals. 

How long your personal data will be retained for depends on whether your Application is successful.  If your Application is not successful, personal data from your Application will be kept in accordance with RXO policy, and as necessary for RXO to comply with applicable laws and regulations and to defend or prosecute legal claims.  RXO may contact you about other positions for which may be of interest to you in the future. If your Application is successful and you become employed by us, personal data from your Application will be kept, during your employment and for a period thereafter in accordance with RXO policy, and as necessary for RXO to comply with applicable laws and regulations and to defend or prosecute legal claims.

If you have any questions, concerns or complaints regarding RXO’s processing of your personal information or how your information is being handled, please send an email to gdpr@RXO.com or ComplianceOffice@RXO.com. Where permitted by law to do so, you may request a copy of your information (so long as such request does not violate the rights and freedoms of others), request to access your information, request correction of any incorrect personal information you may become aware of, and request the deletion of personal information, and we will respond accordingly where required by law. These rights may be subject to legal restrictions as provided by applicable law.  

In relation to the processing of your information by the RXO, you have the following additional rights not previously described:

  • Request correction of the personal information that RXO holds about you. This enables you to have any incomplete or inaccurate information RXO holds about you corrected.
  • Request erasure of your personal information. This enables you to ask RXO to delete or remove personal information where there is no legal basis for RXO continuing to process it.
  • Request the restriction of processing of your personal information. This enables you to ask RXO to suspend the processing of personal information about you, for example if you want RXO to establish its accuracy or avoid the erasure of the personal data.
  • Request the transfer of your personal information to another party, i.e. the right to data portability, where you have the right to receive your personal data in a structured, commonly used and machine-readable format and have the right to transmit that data to another controller without hindrance from RXO.
  • The right to complain to the relevant supervisory authority.
